TERMS OF SERVICE
Rental Agreement
This Private Charter Rental Agreement is entered into as of the date of the final booking confirmation (the “Effective Date”) by and between Pearl Party Boat (“Company”), and the individual or entity identified in the booking summary (“Charterer”).
The Vessel & Service
Company agrees to provide the vessel known as “The Pearl” (the “Vessel”) for a private charter. The charter includes the services of a professional USCG-licensed Captain and crew. The Vessel is a two-floor luxury lounge featuring an upper deck with 360-degree views and a maximum capacity of 45 guests, including the Charterer.
Charter Details
The specific date, boarding time, departure time, and return time (the “Charter Period”) shall be set forth in the Charterer’s booking confirmation. Charter period length, pricing, and any add-ons selected are determined per booking and confirmed in writing in the booking summary.
● Boarding: Boarding begins fifteen (15) minutes prior to the scheduled departure.
● Late Arrival: The Charter Period will not be extended due to the late arrival of the Charterer or their guests.
Fees & Payment Terms
● Charter Fee: The total fee includes the vessel rental, Captain, crew, and any selected catering or beverage packages.
● Deposit: A non-refundable deposit of fifty percent (50%) of the boat charter fee is required to secure the date.
● Final Payment: The remaining balance must be paid in full no later than fourteen (14) days prior to the Charter Period.
● Security Deposit: Company reserves the right to hold a credit card on file for a security/damage deposit.
Cancellation & Refund Policy
● Charterer Cancellation: Cancellations made more than thirty (30) days in advance may receive a credit toward a future charter, minus the non-refundable deposit. Cancellations made within fourteen (14) days of the charter are non-refundable”. Exceptions may be considered for documented medical emergencies involving immediate family, at the owner’s discretion”
● Company Cancellation: If the Company must cancel due to mechanical failure or unforeseen circumstances, a full refund or rescheduling option will be provided.
Weather Policy
Charters take place rain or shine. The Captain, at their sole discretion, may cancel or delay the charter in the event of severe or unsafe weather conditions (e.g., high winds, lightning). If the Captain cancels the charter prior to departure due to safety concerns, the Charterer may reschedule or receive a full refund.
Passanger Conduct & Safety
● Captain’s Authority: The Captain is in full command of the Vessel at all times. The Charterer and all guests must comply with all instructions given by the Captain and crew.
● Capacity (Strict): The Vessel is strictly limited to 45 guests total. Company may deny boarding or require removal of any person in excess of capacity, and the Charter Period will not be extended as a result.
● Safety & Movement: No running; no climbing on railings/furniture; guests must remain within permitted areas and follow all posted safety signage. Upper deck access may be limited by the Captain/crew due to weather, wake conditions, or safety.
● Intoxication/Disruptive Conduct: Company may refuse service of alcohol, require a guest to stop consuming alcohol, or remove any guest whose behavior is unsafe, aggressive, discriminatory/harassing, or disruptive, in the sole discretion of the Captain/crew, without refund.
● Illegal Substances: The use of illegal drugs or any illegal activity is strictly prohibited. Discovery of such substances will result in immediate termination of the charter without refund and notification of authorities.
● Minor Guests: Guests under the age of 18 must be supervised by an adult at all times.
● Prohibited Items: No glitter, confetti, open flames, or pets are allowed on the Vessel.
Catering & Beverages
● Options: Charterer may select optional gourmet catering and premium beverage packages through Company, as described in the booking summary, which may include offerings from approved restaurant partners.
● Alcohol: If a beverage package is purchased, alcohol service will be managed by the crew. Company reserves the right to refuse service to any guest who appears intoxicated. No outside alcohol is permitted unless specifically authorized in writing.
● Food: Only catering provided by Company or its approved partners is permitted, unless a “self-catering” fee has been paid and approved.
SIGNAGE, DECORATIONS & BRANDING
● “Personalized Pearl” Signage (Banners): For “Personalized Pearl” packages, external banners are permitted only up to 8x 4′ must be approved by Company in advance.
● Professional Mounting Only: All banners, décor, and lighting customizations must be installed, mounted, and removed by Company’s crew (or Company- approved professional) only. Charterer and guests may not tape, drill, staple, lash, or otherwise attach items to any part of the Vessel.
● No Litter / Secure Attachment: All materials must be securely fastened so they cannot detach and enter the lake/waterway. Charterer is responsible for any additional cleaning, retrieval, fines, or damage arising from unauthorized or improper materials/attachment.
● Lighting (No Flashing/Strobe): LED lighting customizations must not include flashing, strobe, or other attention-attracting effects and must not interfere with navigation, visibility, or required safety lighting.
● Branding Must Be Personal/Private Only: Banners, names, logos, and branding are permitted only for the Charterer’s private/personal event use. No third-party commercial advertisements, sponsorships, political ads, or promotional messaging are permitted.
● Company Discretion: Company may refuse, modify, or remove any banner, décor, or lighting that, in Company’s judgment, creates a safety risk, violates law/regulation, damages the Vessel, or conflicts with Company policies, without refund of add-on fees.
LIABILITY AND INDEMNIFICATION
● Assumption of Risk: Charterer acknowledges that being on a vessel involves inherent risks. Charterer assumes all risks associated with the charter for themselves and their guests.
● USCG / Laws / Safety Compliance: Charterer and guests must comply with all applicable federal, state, and local laws and regulations, including USCG requirements and all safety instructions given by the Captain and crew. The Captain may alter the route, delay departure, return to dock, limit access to areas (including the upper deck), or terminate the charter for safety or compliance reasons, without refund.
● Indemnity: Charterer agrees to indemnify and hold harmless Pearl Party Boat, its owners, employees, and agents from any claims, damages, or expenses arising from the Charterer’s or their guests’ conduct.
● Damage: Charterer is financially responsible for any damage to the Vessel, its equipment, or furniture caused by the Charterer or their guests beyond normal wear and tear.
GOVERNING LAW
This Agreement shall be governed by the laws of the State of Illinois and anyapplicable federal maritime laws. Any disputes arising from this Agreement shall be resolved in the courts located in Cook County, Chicago.
By completing the booking and paying the deposit, the Charterer acknowledges that they have read, understood, and agreed to the terms of this Private Charter Rental Agreement.
Private Charter Addendum & Booking Details
This Private Charter Addendum & Booking Details (the “Addendum”) is entered into as of 04/27/26, by and between Pearl Party Boat and the individual or entity identified below. This Addendum is incorporated into and made a part of the Private Charter Rental Agreement (the “Main Agreement”) for the use of the vessel The Pearl.
The Charterer agrees to pay the following fees associated with the private charter of The Pearl. All prices are in USD.

C. Total Charter Cost
A. Service Fee: A mandatory 20% service fee is applied to the subtotal of all charter costs. This fee covers administrative overhead, coordination, and onboard service staff. This is separate from any additional discretionary gratuity provided to the Captain or Crew.
B. Catering & Liquor: Food selections are finalized through Owner’s preferred catering partners. Beverage service is subject to Illinois Liquor Control Commission regulations. No outside alcohol is permitted unless expressly agreed upon in writing.
C. Decorations & Branding: Pursuant to the Main Agreement, all decorations must be professional in nature. “Personalized Pearl” banners are limited to 60 sq. ft. (15′ x 4′). No strobe or flashing LED lights are permitted. All decorations must be removed at the end of the charter unless otherwise specified.
D. Entertainment: Owner provides state-of-the-art sound systems. Any third-party entertainment (DJs, performers) must be approved by the Owner 7 days prior to the event to ensure electrical and safety compatibility.

Charter Guidelines & Regulations
Safety
- Listen carefully to the safety briefing before departure.
- Know the location of life jackets, fire extinguishers, and emergency equipment.
- Wear a life jacket whenever instructed by the captain.
- Keep hands, feet, and personal belongings clear of docking lines and moving equipment.
- Stay seated or hold onto handrails when the boat is underway or in rough water.
- Never swim or enter the water unless the captain gives permission.
While on Board
- Follow all instructions from the captain and crew promptly.
- Be respectful of other passengers and maintain a positive atmosphere.
- Keep walkways clear of bags, coolers, and fishing gear.
- Dispose of trash in designated containers.
- Avoid excessive alcohol consumption or any illegal substances.
- Supervise children at all times.
- Keep noise at a reasonable level so safety instructions can be heard.
Protecting the Boat
- Treat the vessel and equipment with care.
- Do not tamper with controls, electronics, or safety equipment.
- Report any accidental damage or equipment issues immediately.
Environmental Responsibility
- Do not throw trash, plastics, or cigarette butts into the water.
- Respect marine wildlife by observing from a safe distance.
Courtesy
- Respect the captain’s decisions regarding weather, routes, and safety.
- Be patient during docking, launching, and fish handling.
- Show appreciation to the crew if they provide exceptional service.
At the End of the Trip
- Gather all personal belongings before leaving.
- Follow crew instructions for disembarking.
- Check that you have all valuables before departing.
- Leave the boat as clean as you found it.
